Terms of Service

1. Acceptance of Terms

By creating an account, purchasing tokens, or otherwise using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Smart Yard Yap provides AI-generated advisory content — including photo diagnostics, seasonal task suggestions, and weather-informed lawn briefings — for informational lawn care purposes only. Recommendations are algorithmic and may be wrong. Nothing on the Service is professional agronomic, veterinary, chemical, or regulatory advice. You are solely responsible for any product, chemical, or irrigation decision you make based on the Service.

3. Accounts

You must be at least 13 years old to create an account. You are responsible for the security of your credentials and for all activity that occurs under your account. Notify us at support@smartyardyap.com if you suspect unauthorized access.

4. Tokens, Purchases & Refund Policy

Certain features of the Service — including AI photo diagnostics and custom weather checks — are paid using in-app Tokens. Tokens are a single-use digital consumable product delivered instantly to your account after a successful payment through our payment processor.

• Tokens have no cash value, cannot be transferred between accounts, and cannot be redeemed for currency.
• Token purchases are billed in U.S. dollars and are final at the time of purchase.
• Once a Token has been consumed — for example, once an AI diagnostic report is generated or a custom weather check is returned — that Token is fully non-refundable, because the underlying AI service has already been delivered and paid for on your behalf.
• Unused Tokens may be reviewed for a refund at our sole discretion within 14 days of purchase by emailing support@smartyardyap.com. Duplicate or fraudulent charges will always be refunded.
• We may adjust Token pricing, pack sizes, or bundled features at any time. Changes will not affect Tokens you have already purchased.

5. Acceptable Use

You agree not to:

• Upload content you do not own or have permission to upload.
• Upload people, license plates, or other personal information as a diagnostic photo — the Service is intended for lawn imagery.
• Attempt to reverse-engineer, resell, or automate scraping of the Service, its AI outputs, or its APIs.
• Use the Service to violate any law or third-party right.

6. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Smart Yard Yap disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI diagnostics will be accurate, complete, or safe for your specific lawn, chemistry, or region.

7. Limitation of Liability

To the maximum extent permitted by law, Smart Yard Yap's total liability arising from or related to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $50, whichever is greater. We are not liable for indirect, incidental, consequential, special, or punitive damages.

8. Termination

You may stop using the Service at any time. We may suspend or terminate an account for violation of these Terms, for abusive use, or to comply with the law. On termination, unused Tokens are forfeited unless required otherwise by law.

9. Changes

We may update these Terms from time to time. Material changes will be highlighted on this page and, when appropriate, notified by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
